This is the last Will and Testament of me John Gooderson of the City of Norwich Linen Draper First I nominate and appoint my dear Wife Mary Ann Executrix and my Friend and Partner William Moll of the said City Linen Draper my Son in Law Frederic Bateman of the said City Medical Doctor and my friend Henry Spelman of the said City Auctioneer Executors and Trustees of this my Will And I direct that all my just debts funeral expenses and the charges and expenses of proving and executing this my Will may be paid and satisfied by and out of my Personal Estate as soon as conveniently can be after my decease And I give and devise unto my said Wife All that my messuage or dwellinghouse with the offices grounds and appurtenances to the same belonging situate and being in Heigham Fields in the Hamlet of Heigham in the County of the City of Norwich and now in my own occupation And also all that my messuage or dwellinghouse with the offices and appurtenances to the same belonging situate and being at Heigham Hill in the Hamlet of Heigham aforesaid and now in the occupation of Mr Flowerdew To hold the same respectively with the appurtances unto my said Wife for and during the term of her natural life she keeping the same in good and tenantable repair and insured from loss or damage by fire And from and immediately after the decease of my said Wife I give and devise the said messuages or dwellinghouses with the offices and appurtenances to the same belonging unto my daughter Emma Brownfield Bateman and her heirs for ever And I give and bequeath unto my said Wife the sum of Two hundred pounds Sterling money to be paid to her within one Calender month after my decease Also I give and bequeath unto my said Wife All my household furniture plate linen clunce household effects and household stores of every description to and for her own proper use and benefit And I give and bequeath unto my said Daughter Emma Brownfield Bateman the sum of Two thousand pounds Sterling money to and for her own proper use and benefit And I give and bequeath to my Son in Law the said Frederic Bateman the sum of Five hundred pounds Sterling money for his own proper use and benefit And I direct that the said last mentioned Legacies shall be paid within twelve Calendar months next after my decease And I give and bequeath to each of the children of my said Daughter Emma Brownfield Bateman (that is to say) Gertrude Emma Gooderson Bateman, Constance Isabell Bateman and Frederic John Brownfield Bateman the sum of Two hundred and fifty pounds Stirling money to be paid to them as and when they shall respectively attain the age of twenty one years And in the meantime I direct that the said Legacies shall be placed out or invested at interest in or upon Real or Government Security or Securities and that my said Trustees and Executors shall from time to time invest and accumulate the interest and income to arise from the said Legacies respectively until the same respectively shall become payable and then to pay over such respective accumulations with the legacies respectively to which the same shall respectively belong And in case any of my said Grandchildren shall depart this life under the age of twenty one years then I give and bequeath the legacy or legacies of him her or them so dying together with the accumulations of the interest dividends and produce of the same unto the survivors or survivor of them if more than one in equal shares and if but one then wholly to that one And my Will is that as to the sum of Six thousand pounds part of my general Personal Estate the same shall be held by my said Executors and Trustees their executors and administrators upon trust that they my said Executors and Trustees or the survivors or survivor of them or the Trustees for the time being acting under this my Will do and shall lay out and invest the same at interest in or upon some or one of the Public Stocks or Funds of Great Britain or on real securities in England in their or his names or name and alter vary and change the same securities as occasion shall require or as they shall think fit and do and shall stand and be possessed of the same trust money stocks funds and securities and the dividends and annual income thereof upon trust to pay the interest dividends and annual income arising therefrom unto my said Wife for and during the term of her natural life and from and after her decease Upon trust to pay the same unto my said Daughter Emma Brownfield Bateman for and during the term of her natural life and from and after her death Upon trust to pay the same interest dividends and annual income unto my Son in Law the said Frederic Bateman for and during the term of his natural life And from and after his decease Upon trust for the Child if only one and if more than one then all the Children of my said Daughter Emma Brownfield Bateman already born or hereafter to be born to be equally divided between or among the same children if more than one in equal shares and proportions as tenants in common and not as joint tenants the shares of Sons to be vested in them respectively at their respective ages of twenty one years or deaths under that age leaving lawful issue living at that time and if daughters at their respective ages of twenty one years or days off Marriage which shall first happen and to be paid to them respectively as soon after the said respective days or ages shall be attained and also after the decease of my said Wife and Daughter and Son in Law as conveniently may be And in case any of the said Children being a Son or Sons shall die under the said age of twenty one years and without leaving any lawful issue of his or their body or bodies living at his or their death or respective deaths or being a daughter or daughters shall die under that age and before she or they shall be married Then as well as to the original as also the accruing share of each such Child and the accumulations thereof if any Upon trust for the other or others of the said Children of my said Daughter to be equally divided between them as tenants in common and not as joint tenants and to be vested and payable at the same days and times as their original shares or as soon after the death of each Child so dying as conveniently may be Provided always and I hereby declare that it shall and may be lawful to and for the Trustees or Trustee for the time being acting under this my Will at any time or times after the several deceases of my said Wife Daughter and Son in Law to apply all or any part of the dividends interest and income arising from the portion of each any or either of the Children presumptively entitled to the said trust monies stocks funds and securities during his or her minority in or towards his or her maintenance education schooling clothing and advancement in such manner as the said Trustees or Trustee for the time being shall think fit and also at any time after the several deceases of my said Wife Daughter and Son in Law or in their lifetime respectively with their consent in writing respectively to advance and pay to and for each any or either of the Children presumptively entitled as aforesaid notwithstanding his or her minority any part not exceeding one half of the then vested or expectant share of the same Child of and in the said trust money stocks funds and securities either for placing out any such Child being a male to any profession or employment or in the purchase of a commission or promotion for him in the Army or in the education of any such Child being a male at any University or Universities or for the advancement or preferment in the World or in Marriage of such Child or Children being either male or female And further that all sums of money which shall be so advanced to and for each such Child as aforesaid shall be deducted or allowed out of the portion or share hereby intended to be provided for the same Child notwithstanding his or her death before his or her portion shall be absolutely vested And further that so much of the interest dividends and annual income accruing from the portion or share of the same Child as shall not be applied for his or her maintenance and advancement shall from time to time be added to the principal money of the said portion or share and be improved at interest together with the same and as a part thereof by way or in the nature of compound interest and be subject to all the trusts and dispositions herein contained of and concerning the principal of the same portion or share until the same principal money or the securities on which the same shall be invested shall become payable as or are hereby directed to be paid assigned or transferred And I give and bequeath to my Brother in Law John Brownfield the sum of Nineteen Guineas To my friend the said William Moll the sum of One hundred pounds and to my friend the said Henry Spelman the sum of Thirty pounds for his care and trouble in the execution of this my Will And to William Moll (Son of Mr Robert Moll) who is in my Service the sum of Nineteen Guineas And I direct that the said last mentioned Legacies shall be paid within twelve Calendar months next after my decease And I give devise and bequeath unto my said Wife All my part share and interest whatsoever of and in the messuage or dwellinghouse shop and premises situate in the Parishes of St. Peter of Mancroft and St. Gregory in the said City of Norwich and now in the occupation of myself and Partner and of Mrs Norton and generally all my real and personal Estate not hereinbefore disposed of To hold the same to her my said Wife her heirs executors and administrators absolutely And I appoint her residuary Legatee under this my Will And I empower my said Partner William Moll notwithstanding his being one of my Executors to become the purchaser of my share and interest of and in the stock in trade fixtures and effects in and about the shop and premises in which I carry on the trade or business of a Linen Draper in Partnership with him at a fair valuation to be made by two indifferent persons one to be chosen by the said William Moll and the other by the other Executors and Trustees acting under this my Will and in case of their disagreement then by an Umpire to be chosen by such two persons before they commence their valuation And I give and devise unto the said William Moll Frederick Bateman and Henry Spelman (my Executors) their heirs executors administrators and assigns All such Estates as at the time of my decease shall be vested in me upon any trust or by way of Mortgage To hold the same unto and to the use of the said William Moll Frederic Bateman and Henry Spelman their heirs executors administrators and assigns for all my estate and interest therein subject nevertheless to the equities affecting the same respectively and to the intent that such of the trusts and purposes affecting the said trust premises as at the time of my decease shall be subsisting may be carried into effect And lastly I revoke all former Wills by me made and declare this only to be my last Will and Testament In Witness whereof I the said John Gooderson the Testator have to this my last Will and Testament contained in four sheets of paper subscribed my name this eighth day of November in the year of our Lord One THIS IS A CODICIL to the last Will and Testament of me John Gooderson of the City of Norwich Linen Draper which Will bears the date the eighth day of November One thousand eight hundred and fifty nine Whereas since the date and execution of my said Will my dear Wife Mary Ann Gooderson hath departed this life Now in consequence of that event I declare that the benefits which by my said Will were intended for my Daughter Emma Brownfield Bateman upon or immediately after the decease of my said Wife whether from my real or my Personal Estate shall now take place and fall in to her my said Daughter immediately after my decease and as fully and effectually from the happening of my death as the same would have been by my said Will after the decease of my said Wife in case she had survived me And I give and bequeath to my said Daughter all my household furniture plate linen china household effects and household stores of every description to and for her own proper use and benefit And I give and bequeath to my said dear Wife's much beloved friend Miss Martha Bousfield of Brixton Hill Surrey the sum of Nineteen Guineas Also I give and bequeath to my friend Amelia Burls of Highbury Middlesex now staying with me the sum of Nineteen Guineas And I appoint my said daughter Emma Brownfield Bateman my residuary Legatee and likewise Executrix and Trustee of my said Will in the place and stead of my said Wife and in all other respects I confirm my said Will In witness whereof I the said John Gooderson the Testator have to this Codicil to my said Will contained in one sheet of paper subscribed my name the twentieth day of April in the year One thousand eight hundred and sixty |
