THIS IS THE LAST WILL AND TESTAMENT of me JOHN GOODERSON of Marham in the County of Norfolk Shoemaker Whereby I nominate constitute and appoint my Son Robert Gooderson of Balburn Street City Road London Tailor and my Daughter Ann Gooderson of Marham aforesaid Spinster to be an Executor and Executrix of this my Will And I authorize and direct them to pay all my just debts funeral expences and the costs and charges of an attending the proving this my will as soon as conveniently can be after my decease I give and bequeath unto my said Son Robert a Legacy or sum of Ten pounds to my said Daughter Ann a like legacy or sum of Ten pounds and to my Daughter Harriot the Wife of Robert E……. a legacy or sum of Ten pounds to be paid to them within three calendar months next after my decease And I give and devise unto my dear Wife Ann All those my five freehold Cottages or Tenements hereditaments and premises situate and being at Marham aforesaid And also all those two acres of Land or thereabouts situate in Marham aforesaid and all other my real Estate whatsoever and wheresoever and of whatever nature or tenure the same may be with their appurtenances of which I may be possessed of at the time of my decease To hold the same unto her my said Wife and her assigns for and during the term of her natural life she keeping the buildings in good and substantial repair and committing no manner of waste thereon And I also give and bequeath unto my said Wife Ann all my household furniture plate linen stock in trade goods chattels and effects and all other my Personal Estate To use and enjoy the same for and during the term of her natural life And from and immediately after the decease of my said Wife I give devise and bequeath all and singular my Cottages or tenements lands hereditaments and real estate whatsoever and wheresoever and also All and singular my household furniture goods chattels and effects and also all other my personal Estate unto and to the said Robert Gooderson and Ann Gooderson their heirs executors administrators and assigns Upon trust to sell and dispose of my said real Estate unto any person or persons either altogether or in parcels and either by public Auction or private contract or partly in one move and partly in the other and at such price or prices as my said Executors shall think proper with power to purchase in the same at any Auction or Auctions and also to rescind or alter any contract for sale entered into and to make and enter into special conditions and stipulations with any purchaser or purchasers relative to title or otherwise and do and shall for the purpose of carrying into effect such contracts for sale make and execute all necessary conveyances and assurances to their respective purchasers thereof or as they shall order or direct And as to the personal Estate and effects so bequeathed as aforesaid Upon trust that they my said Executors their executors administrators or assigns do and shall sell convert and dispose of the same and every part thereof And after deducting or retaining thereout all costs charges and expences attending such sale or sales and carrying the trusts of this my will into effect that they my said Executors shall stand and be possessed of the residue of the monies to arise from the sale of my said real and personal Estate Upon trust to pay devise and distribute the same equally between and amongst themselves and all other my Children that may be then living and the Child or Children of any of my Sons or Daughters that may have died or be then dead leaving any Child or Children him or her surviving so that such Child or Children as the case may be shall have and be entitled to the share under this my Will that his her or their parent would have been entitled to if living And I declare that the receipts in writing of my said Executors shall be good and effectual discharges for all sums of money arising from the sale and conversion of my said real and personal Estate and shall effectually discharge the person or persons paying the same from all responsibility of seeing to the application thereof and from all liability to the misapplication or non application thereof And I declare that my said Executors shall not be Answerable or accountable for any involuntary loss that may happen or arise to any part of my Estate or Effects nor for the act deeds or defaults of the one for the other of them but each for his own acts deeds and defaults only And lastly I hereby revoke and make void all former and other Wills and testamentary dispositions by me at any time heretofore made and declare this only to be and contain my last Will and Testament In Witness whereof I have to this my last Will and Testament contained on three sheets of paper set my hand this seventh day of September One thousand eight hundred and sixty three |
