JOHN GOODERSON OF CROFT, LINCOLNSHIRE – 1879

 
 

This is the last Will and Testament of me John Gooderson of Croft in the County of Lincoln Farmer I give and bequeath all my personal estate unto my Wife Elizabeth Gooderson absolutely I give and devise my messuage or dwellinghouse situate in Croft aforesaid in which I now reside with the yard garden and homestead or close of pasture land thereto adjoining and belonging containing about three acres with the appurtenances And also my close piece or parcel of land situate in Thorpe Saint Peter in the said County containing three acres and four perches which I purchased of Marshall Heanley unto and to the use of my said Wife Elizabeth Gooderson her heirs and assigns I give and devise all my real estate (Except what I otherwise devise by this my Will or any Codicil hereto) unto my said Wife Elizabeth Gooderson during her life And after her death I give and devise my said real estate (except what I otherwise devise by this my Will or any Codicil hereto) unto and to the use of my Friends Richard Jennings of Burgh le Marsh in the said County Farmer Henry Smith of South Stoke in the said County Farmer and Joseph Bassitt of Wainfleet All Saints in the said County Gentleman their heirs executors and administrators respectively according to the nature and tenure thereof Upon trust that the said Richard Jennings Henry Smith and Joseph Bassitt or the survivors or survivor of them or the heirs executors or administrators of such survivor shall sell the same either together or in parcels and either by public auction or private contract and may buy in and reocind any contract for sale and resell without being responsible for any loss occasioned thereby and execute and do all such assurances and acts for effectuating any such sale as they or he shall think fit And I declare that the said Richard Jennings Henry Smith and Joseph Bassitt or the survivors or survivor of them or the heirs executors or administrators respectively of such survivor shall hold the monies to arise from the sale of my said real estate In trust as to one equal fourth part thereof for my Nephews and Nieces (the children of my Brother William Gooderson) in equal shares As to one other equal fourth part thereof for my Nephews and Nieces (the children of my Brother Matthew Gooderson) in equal shares As to one other equal fourth part thereof for my Nephews and Nieces (the children of my Sister Amelia Davey) in equal shares And as to the remaining one equal fourth part thereof for the children of Susan Clarkson (the Sister of my said Wife Elizabeth Gooderson) in equal shares And I hereby declare that the receipt of the Trustees or Trustee for the time being acting in the execution of any of the trusts hereof for the purchase money of the property sold shall effectually discharge the purchaser or purchasers paying the same therefrom and from being concerned to see to the application thereof And I hereby declare that the power of appointing a new Trustee or Trustees of this my Will shall be exerciseable by my said Wife during her Widowhood and after her death or remarriage by the surviving or continuing Trustees or Trustee for the time being or the acting executors or executor administrators or administrator of the last surviving or continuing Trustee or by the last retiring Trustees or Trustee And upon any such appointment the number of Trustees may be augmented or reduced I devise all real estate vested in me upon trust or Mortgage unto the said Richard Jennings Henry Smith and Joseph Bassitt their heirs and assigns upon the trusts and subject to the equity of redemption subsisting therein respectively but the money secured on such Mortgages shall be considered as part of my personal estate And I appoint my said Wife Elizabeth Gooderson and the said Richard Jennings Henry Smith and Joseph Bassitt Executrix and Executors of this my Will I direct that my Trustee Joseph Bassitt whether he shall accept the Trusteeship or not shall be the Solicitor to my trust property and as such notwithstanding his acceptance of the Trusteeship be allowed all professional charges which if employed as Solicitor to my Trustees not being himself a Trustee he would be entitled to make Lastly I revoke all other Wills In Witness whereof I have hereunto set my hand this twenty fourth day of May One thousand eight hundred and seventy eight

Proved at Lincoln the sixth day of October 1879 by the oaths of Elizabeth Gooderson Widow the Relict and Joseph Bassitt two of the Executors to whom Administration was granted. Richard Jennings and Henry Smith the other Executors named in the Will having renounced the Probate and execution thereof

The Testator John Gooderson was late of Croft in the County of Lincoln Farmer and died on the thirtieth day of May 1879 at Croft aforesaid
