THIS IS THE LAST WILL AND TESTAMENT of me Elizabeth Gooderson of Number 3 Elgin Villas Grayshort Road Lavender Hill Wandsworth in the County of Surrey Widow In exercise of the powers for this purpose given to me by two Indentures of settlement dated respectively the second day of June one thousand eight hundred and sixty eight and the twelfth day of November one thousand eight hundred and sixty eight and of all other powers (if any) in me given enabling me in this behalf I do by this my last Will and testament appoint Robert Iain Frazer of number 8 Seymour Terrace Lavender Hill Wandsworth in the said County of Surrey Doctor of Medicine and Ernest Robert Champion of number 17 Ironmonger Lane London Solicitor (hereinafter called ‘my said trustees’) to be Executors and trustees of this my Will I give and appoint the real and personal estate over which I have any disposing power unto my said trustees In trust as and when they shall think fit to convert the same into money and invest the proceeds thereof in any investments authorised by law for trust funds with power to vary such investments at their discretion I direct appoint and give to James Cotter and John Cotter sons of Hannah Cotter of number 104 Blackford Street Indianapolis Indiana in the United States of America Widow the legacy or sum of five hundred pounds each to Annie Cotter daughter of the said Hannah Cotter five hundred pounds to my niece Elizabeth Rory of Balmain in the Colony of Iptney Widow the legacy or sum of one hundred pounds I direct and appoint and give all the rest and residue of my property unto and equally among the said Hannah Cotter and my three grand daughters Ellen Cotter Margaret Cotter and Mary Cotter or such of them as may be living at my decease And I declare that the share of any woman taking any interest under this my Will and the appointment hereby made shall be for her sole and separate use and free from the debts control or engagements of any husband with whom she may intermarry and I declare that the said Ernest Robert Champion and any future trustee of this my will who may be a Solicitor shall be entitled to charge my estate for all business done by him in relation to my estate in the trusts of this my will in the same manner as he would have been entitled to charge for the same if he had not been himself an Executor or trustee but had been employed to do such business And lastly I hereby revoke all former Wills and testamentary dispositions by me at any time heretofore made and declare this only to be my last Will and testament In testimony whereof I have hereunto set my hand this twenty eighth day of April one thousand eight hundred and eighty seven the mark of the said Elizabeth Gooderson Signed by the said Elizabeth Gooderson (the testatrix) by her making her mark thereto (she having declared to us that the above Will had been read over to her by Charles Champion Solicitor of No 17 Ironmonger Lane London and that she had a perfect knowledge of its contents) as and for her last Will and testament in the presence of us both present at the same time who in her presence at her request and in the presence of each other have hereunto subscribed our names as witnesses – W.C. THIS IS A CODICIL to the last Will and testament dated the 28th day of April 1889 of me Elizabeth Gooderson now residing at No 11 Eland Road Lavender Hill Wandsworth in the County of Surrey Widow Whereas I have not for many years heard of my niece Elizabeth Rory mentioned in my Will and described as of Balmain in the Colony of Iptney Widow and I am afraid she is dead Now I hereby revoke the legacy by my said Will given to her and do give the said legacy or sum of one hundred pounds to my niece Alice Mary Neilson wife of John M Neilson of 69 Gowrie Road Lavender Hill aforesaid for her sole separate use and benefit and I also give and devise unto the said Alice Mary Neilson all furniture and effects in or about my present dwellinghouse as well as all my wearing apparel and jewellery In all other respect I confirm my said Will In testimony whereof I have hereunto set my hand this sixteenth day of June one thousand eight hundred and eighty eight – The mark of Elizabeth Gooderson – Signed published and declared by the said Elizabeth Gooderson the testatrix by her making her mark thereto she having declared to us that the above Will had been read over to her by Charles Goble Champion Solicitor of No 17 Ironmonger Lane London and that she had a perfect knowledge of the contents as and for her last Will and testament in the presence of us both present at the same time who in her presence at her request and in the presence of each other have hereunto subscribed our names as witnesses – Rachel Margaret Jago 11 Eland Road wife of John Jago Civil Service South Kensington – Charles Goble Champion 17 Ironmonger Lane E C Solicitor. |
