ELIZABETH GOODERSON OF HARROW, MIDDLESEX – 1909

 
 

THIS IS THE LAST WILL and TESTAMENT of me ELIZABETH GOODERSON of 5 Nelson Road Harrow in the County of Middlesex Widow I appoint John Alfred Massey of West Street Harrow aforesaid Undertaker and Charles William Haynes of the same place Newsvendor EXECUTORS and TRUSTEES of this my will I Bequeath to my said executors John Alfred Massey and Charles William Haynes the sum of twenty pounds each free of legacy duty this bequest to be conditional on their acting as executors and trustees I devise and bequeath all the residue of my real and personal property to my trustees upon trust to call in and convert the same into money and after the payment of my debts funeral and testamentary expenses to divide the same between my children William Edward Mary Elizabeth George Herbert Walter Sidney Rose Alice Arthur John and Ernest James equally as tenants in common I direct that my trustees may postpone the sale or conversion of my estate into money for so long as they shall think fit and I give them full power to grant leases and repair my real property as they shall think desirable And I declare that if any of my executors or trustees is an Undertaker he may be employed so to act and shall be entitled to charge and be paid for all work done or services rendered in the way of such business IN WITNESS whereof I have hereunto set my hand this sixteenth day of March one thousand eight hundred and ninety seven – E. I ELIZABETH GOODERSON of 5 Nelson Road Harrow on the Hill in the County of Middlesex Widow declare that this paper writing is a CODICIL to my will dated the sixteenth day of March one thousand eight hundred and ninety seven Whereas I have advanced moneys to my children and they pay me interest for the same Now I declare that no child shall take any part of his or her share in my bequest to him or her in my said will unless he or she shall bring into hotchpotch and account for the sums so advanced to them or any of them in my lifetime so that the same may be allowed as part of their share And I further declare that the bequest of the trust funds given by my said will to my trustees is on the express condition that if previous to distribution by them any event shall happen whereby the share of any child of mine if belonging absolutely to him or her would become vested in some other person or persons or a corporation then my trustees shall thenceforth in their uncontrolled discretion pay or apply the said share to the benefit of the said child and his wife and child or children or remoter issue for the time being whether minors or adults or any of such persons to the exclusion of the others or other of them as my trustees shall think fit subject however to the advances in favor of such child being brought into hotch potch as herein expressed And I declare that my trustees shall decide any dispute as to the advances so paid to them by me and that their decision shall be final and absolutely binding upon my children also that my trustees shall not be responsible if they pay the share to any of my children after the happening of such an event as aforesaid but without knowledge of it IN WITNESS whereof I the said Elizabeth Gooderson have hereunto set my hand this twentieth day of June one thousand nine hundred and three – E. I ELIZABETH GOODERSON of 5 Nelson Road Harrow on the Hill in the County of Middlesex Widow declare that this paper writing is a CODICIL to my Will dated the sixteenth day of March one thousand eight hundred and ninety seven Whereas I have since the execution of my said will made advances to some of my children as set forth in the Schedule hereunder written and I declare that all sums of money so lent and not hereafter repaid to me together with all interest and arrears of interest at the rate of four pounds per centum per annum shall be considered as advances made by me to my children and all sums of money so lent and paid by me shall be taken into account as part payment of their share under my said will notwithstanding that one or more of my said children shall be adjudged bankrupt and that the loan as a debt may be released by the bankruptcy and that if the amount of indebtedness for such advances and interest be in excess of any share accruing to them under my said will then I declare that such amount shall be paid to my executors and form part of my estate in such cases where it can be legally demanded In all other respects I confirm my said will and my codicil of the twentieth day of June one thousand nine hundred and three IN WITNESS whereof I the said Elizabeth Gooderson have hereunto set my hand this fourteenth day of May one thousand nine hundred and six.
